NOTE SUBMITTED TO NCCPA HEAD QUARTERS ON VII CPC REPORT

1.      Minimum Pay:-
           The specifications for the need based minimum wage were derived by the VII CPC from the recommendations of Dr. Aykroyd according to which an adult male engaged in moderate activity should on a daily basis should consume 2700 calories of food. But for a female it is 2160 calories (0.8 unit) and for two children upto 14 years of age 1620 calories each (0.6 units each). The age of 14 years was arrived at in 1957 when the retirement age was 55 years. Now it is 60 years and hence the age of dependent children has to be reckoned upto 19 years. No nutritionist in the 21st century will agree to this calory formula which is obsolete. There should not be any distinction in the calory in take of food particularly in the context that even major children upto the age of 19 years are dependant on the employee. So the multiplication factor should be 4 instead of 3. Then the minimum pay will be Rs.24000/- If it is accepted there will be corresponding increase in all levels of the Pay Matrix to maintain the vertical and horizontal relativities in the Pay Structure.

2.      Minimum Pension:-
           The Commission also endorses the Supreme Court verdict in Nakara Case that a pension scheme must provide a pensioner to live at a standard equivalent at pre-retirement level. Even if the arguments and findings of the CPC in arriving at the minimum wage are accepted a pensioner is legitimately entitled for 1.8 units pension which works out to Rs. 10800 (18000 x 1.8 divided by 3 ) as minimum pension. The rate of pension works out to 60% of last pay drawn  in this case.

3.      Parity in Pension:-
            The present parity in pension as formulated by the CPC is totally different from OROP scheme. While the OROP scheme is beneficial to each and every defence pensioner, the parity scheme proposed is not at all beneficial to more than 60% of the pensioners. To include more pensioners in the ambit of the scheme, parity may be allowed between posts/grades at the pre-retirement and at the present level instead of parity between scales of pay of the past and present.

4.      Age-related additional pension:-
             Almost all the recommendations of VII CPC were made reckoning the opinion of the Department of Pension and  Pensioners’ Welfare where as the Department’s opinion that  the age related additional pension should be allowed from 75 years onwards was discarded by the Commission on a flimsy argument that the Ministry of Defence had not supported the proposal. The stand of the CPC is unjustified. There should be at least 10% increase in pension on attaining the age of 75 years.

5.      Restoration of commuted portion of pension:-
           The commutation factor for those retiring at the age of 60 years is at present 8.194. Therefore the commuted portion should reasonably be restored after 10 years (12 years for pre 2006 retirees) even after discounting the risk factor. The interest portion accrued to Government of India exchequer, on this account, is more than 22% per annum.

6.      Fixed Medical Allowance:-
           Regarding the Health Insurance Scheme, no rational and convincing proposal is put forth by the CPC. However the proposal is not new and it is a long pending one. Till a mutually agreeable Comprehensive Health Insurance Scheme is implemented, the pensioners may be allowed a Fixed Medical Allowance of Rs. 2000/- per mensem, an amount which is allowed to the pensioners of EPF organization who are also governed by the same CCS (Pension) Rules, 1972.

A brief report on the proceedings of the National Convention
of Central Government Pensioners held under the auspices of NCCPA
on 31st July 2015 at Hyderabad
         The National Convention of Central Government pensioners held under the auspices of NCCPA and hosted by Telangana State Pensioners  and Retired Persons’ Association in Sundarayya Vignana Kendra at Hyderabad was presided over by Com. Daktod, leader of C.G.P.A. Nagpur. Com. Prabhakaran Nair of the host organization welcomed the august gathering. Large number of delegates representing various affiliates from different states participated in the convention Twenty Six delegates representing CGPA, Kerala and some delegates of affiliate organizations from Kerala attended the convention.
          Com. A.K.Padmanabhan, President, C.I.T.U, in his inaugural address dwelt at length on the Contemporary, National and international issues and their adverse impact on working class including pensioners and other senior citizens in lucid and erudite manner.
           Com. Sivagopal Mishra the Secretary, Staff, JCM and Patron of NCCPA in his special address mentioned the important issues before the 7th CPC and impressed upon the employees the imperative need to go on strike from 23rd November. He categorically warned the government that indefinite strike would be preponed without notice if the Government attempts to implement the privatization of Railways as per the recommendations of Dr. Bibek Deroy Committee.
           Com. Pathak, President of AIDEF, Com. K.K.N.Kutty, President of Confederation of Central Government Employees & Workers narrated the issues before the Central Government Employees and Pensioners. They exposed the policy of the Government supporting the Corporate and Multi National Companies. They called upon the pensioners to ensure grass-root unity and to support the struggles of the Central Government employees and the working class to defeat the machinations of the Government. Com. Pabitra Ranjan Chakraborty, the Acting Secretary General of NCCPA presented the draft declaration of the Convention, and two resolutions expressing solidarity with the general strike of workers called by 11 central Trade Unions as well as federations and indefinite strike of Central Government employees on 23rd November 2015, and the second on expanding and strengthening of CGHS.
          In the afternoon session, Com. K.G.Jayarajan (General Secretary, AIBDPA), P.S.Nair (General Secretary, Para-Military Pensioners’ Association) and K.Raghavendran (General Secretary, AIPRPA) also addressed the Convention. Representatives of the various affiliates, including the General Secretary, CGPA, Kerala, enthusiastically participated in the discussions. The Acting Secretary General summed up the discussions and in the light of this, the Draft Declaration and resolutions with improvement suggested were unanimously adopted. The Convention came to a conclusion by 08:30 p.m. after the vote of thanks proposed by Com. M.N.Reddy, Chairman of the Reception Committee.

COMRADE SK VYAS IS NO MORE


The legendary leader of the Central Government Employees as well as the Secretary General of BCPC and NCCPA Comrade S.K.Vyas passed away.

Passing away of Com. S. K. Vyas - An irreplaceable loss to Trade Union movement

         With the passing away of Com. S.K.Vyas on 13th February, at the age of 86, the Trade Union movement in general and Central Government Employees and Pensioners’ movement in particular have suffered an irreplaceable loss. In whatever capacities this stalwart of Trade Union movement has served an imprint of his personality was indelibly left behind. The All India Audit and Accounts Association owes its stature and fighting potential to Vyasji who was the Secretary General from 1969 to 1981 and thereafter president up to 39th Conference at Chennai in September 1989. He became the Secretary General of Confederation of Central Government Employees and Workers when he was Additional Secretary General of All India Audit and Accounts Association and continued as such up to 2006, after which he became President. As he had an umbilical attachment to the Central Government Employees he was made adviser to the organization. After retirement on superannuation on  29th February 1988 he took up the cause of Central Government Pensioners as the Secretary General of National Co-ordination Committee of Central Government Pensioners’ Association as well as Bharat Central Pensioners’ Confederation.

           When we reminisce the yeoman services rendered by Vyasji, we will be astounded at his encyclopedia and knowledge and erudition in service matters and Trade Union movement. The way in which he drafted Memoranda submitted to the various Pay Commissions was marvelous and even the Chairmen of the Commissions could not find any loopholes or irrationality in them. The vast knowledge coupled with impeccable integrity and peerless courage of conviction and uncompromising nature on principles are worthy of emulation. In agitations he stood like a General at the warfront and never negotiated out of fear while he never feared to negotiate.

             The loss of this colossus is irreparable and the pensioners and employees are orphaned. While the mortal remains of Vyasji will be consigned to flames at his ancestral house at Jodhpur, his immortal memory will be perennial and an eternal source of inspiration to all of us.
