HON’BLE SUPREME COURT DISMISSES THE REVISION PETITION FILED BY THE GOVERNMENT

Revision of Pension has to be done with effect from 1-1-2006.  Government’s move to allow revision with effect from 24-9-2012 has been defeated.  Hon’ble Supreme Court has dismissed Revision Petition  filed by the Government against the dismissal of the Special Leave Petition  on the matter.

PRESS STATEMENT

Central Government has announced the constitution of 7th Central Pay Commission. Confederation of Central Government Employees & Workers has been raising this demand before the Government right from 2011 onwards and has conducted series of agitational programmes including Parliament March and one day nationwide strike on 12th December 2012.

While welcoming the decision of the Government, we are disappointed to note that our demand for five years wage revision w.e.f. 01.01.2011 and merger of DA has not been considered favourably by the Government. When the public sector employees are given five years wage revision and the erosion in real wages has reached an all time high due to steep price rise, grant of five year wage revision to Central Government employees is fully justified. Similarly every time the Government appointed pay commission merger of DA was also granted. This time Government has not acceded the demand for merger of DA with pay now. Thus by appointing pay commission employees will not be getting any financial benefit now. The demand for inclusion of Gramin Dak Sevaks under the purview of the 7th CPC and grant of merger of DA to GDS is also pending.

In view of the above, the National Secretariat of the Confederation of Central Government Employees and workers urge upon the Government to consider the above demands also favourably failing which the confederation shall be constrained go for further agitational programmes.

Sub: Common Grade pay of Rs. 5400 from the level of Sr Auditor (MACP-III) to ACDA (JTS  Gp.A Post) in DAD.

               A number of representations from serving/retired officers are being received in this HQr’s Office for granting higher Grade Pay of Rs. 6600/- to SAOs and Rs. 7600/- to ACDA (Group-A entry level) on their promotion from feeder grade.
2. The matter was referred to Ministry of Defence (Finance) for taking up the matter with the Ministry of Finance, Department of Expenditure. Consequent to examination, the Ministry has conveyed that “as per Part B of CCS (RP) Rules-2008, the Grade Pay of Audit/Accounts Officer is Rs. 5400/- in PB-2 whereas the Grade Pay of Senior Audit/Accounts Officer is Rs. 5400/- in PB-3. This insinuates there are differences in various entitlements and allowances in the Pay Band to these two posts. Grant of Grade Pay of Rs. 5400/- in different Pay Band to these posts is a conscious decision of the Govt. Further, Grade Pay of ACDA is Rs. 5400/- in PB-3 and this is a Group ‘A’ post. As per Para 7.56.9 of the 6″ CPC Report, the existing parity between posts in various organized cadres shall be maintained. Accordingly, the recommended structure in IA&AD has been extended in case of other organized accounts cadres like Controller General of Accounts, Controller General of Defence Accounts, Railway Accounts, Postal Accounts, Telecom Accounts. Acceptance of the instant proposal will disturb the existing relativities in all the Organized Accounts cadres. Hence, the request to up-grade the Grade Pay of SAO and ACDA to Rs. 6600/- and Rs. 7600/- is not agreed to.”

Government has clarified that submission of Form 14 by the spouse on the death of the pensioner is not necessary in case the pensioner and spouse are holding a joint account.

DA / DR FROM JULY 2013 – CABINET APPROVES 10% DA / DR HIKE WITH EFFECT FROM JULY 2013

Release of additional installment of dearness allowance to Central Government employees and dearness relief to Pensioners, due from 1.7.2013

     The Union Cabinet today approved the proposal to release an additional installment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to pensioners with effect from 01.07.2013, in cash, at the rate of 10 per cent increase over the existing rate of 80 per cent.

     Hence, the Central Government employees as well as the pensioners are entitled for DA/DR at the rate of 90 per cent of the basic with effect from 01.07.2013. The increase is in accordance with the accepted formula based on the recommendations of the 6th Central Pay Commission.

OFFICE MEMORANDUM
Subject: Disbursement of salary/wages/pension to the Central Government Employees in the State of Kerala for the month of September, 2013 on account of ONAM festival.
In view of the ‘ONAM festival, the Government have decided that the salary of all Central Government employees in the State of Kerala for the month of September, 2013 may be drawn and disbursed by the Central Government offices (including Defence, Posts & Telecommunications) on 13th September, 2013.
2. The wages for September, 2013 of the industrial employees of Central Government serving in the State of Kerala may also be disbursed in advance on 13th September, 2013.
3. The pension for September, 2013 of all Central Government Pensioners in the State of Kerala may also be disbursed by Bank/PAOs on 13th September, 2013.
4. The salary/wages/pension so disbursed is to be treated as advance payments and will be subject to adjustment after the full months salary/wages/pension of each employee/pensioner is determined. The adjustment, if any, will be made without exception from the salary/wages/pension as the case may be from the month of September, 2013.
5. The concerned Ministries/Departments are requested to bring these instructions to the notice of their offices located in the State of Kerala for necessary action immediately.
6. Reserve Bank of India is requested to bring these instructions to the notice of all paying branches of all Banks located in the State of Kerala for necessary action immediately.

“Retirement benefits can’t be withheld pending enquiry” : Supreme Court

Giving this ruling, a Bench of Justices K.S. Radhakrishnan and A.S. Sikri said: “It is an accepted position that gratuity and pension are not bounties. An employee earns these benefits by dint of his long, continuous, faithful and unblemished service. Right to receive pension was treated as right to property.”

NATIONAL CONVENTION OF WORKERS

CENTRAL TRADE UNIONS HELD NATIONAL WORKERS CONVENTION
AT NEW DELHI ON 06TH AUGUST 2013

A massive National convention of all Central Trade Unions, Central and State Government Employees &; Teachers Federations and Public Sector employees Unions etc was held at Mavlankar Hall New Delhi on 6th August 2013. The convention was addressed by the leaders of BMS, INTUC, AITUC, CITU, HMS, AIUTUC, TUCC, SEWA, AICCTU, UTUC, LPF. Presidium consisted of the leaders of all the above Central Trade Unions. The resolution adopted by the National convention called upon the workers to organize following.

1. Demonstration/Rallies/Satyagraha at all state capitals with respective statewide mobilization on 25th September 2013
2. Massive Demonstration before Parliament with main mobilization from neighbouring states on 12th December, 2013
3. On the same day of Demonstration before Parliament (12th December 2013), District-level Demonstrations at all District Headquarters all over the country.
4.  Sectoral programme of joint actions for effectively opposing Restructuring, Outsourcing etc. and on sector-specific issues/demands and against Divestment of shares in Pubic Sector Enterprises.
5.  Exclusive Joint Action Programmes on the demand of Minimum Wage and Contract Workers related other demands.

UTTARAKHAND CALAMITY

C.G.P.A., Kerala appeals to all Central Government Pensioners
to donate liberally to Prime Minister’s Relief Fund


              The flash floods on account of unprecedented rains have unleashed devastation on the Himalayan Hill State of Uttarakhand. The magnitude of the tragedy is beyond measure. Countless houses and buildings along the banks of Alakananda and Bhagirathi were washed away. Number of people met with tragic death is reported to be shockingly inestimable. Stretches of roads and communication links have been totally destroyed. Thousands have been rendered houseless.

                As the magnitude and the enormity of the catastrophe continues to unfold, our Prime Minister has called upon the people of this country to donate generously to support their brethren who are the unfortunate and hapless victims of the vicissitudes caused, by the natural calamity. The Prime Minister’s appeal goes like this: 

1.      “At this moment, the affected people need our help to tide over the calamity that has fallen upon them to survive and to rebuild their lives. I request all citizens of India to stand with our distressed fellow-countrymen and actively participate in the national effort to support them at this difficult time.”

                  It needs no special emphasis and mention that Central Government Pensioners have an important and vital role to play in helping the victims of the national calamity. The secretariat of C.G.P.A. Kerala calls upon the entire community of pensioners to donate liberally to the Prime Minister’s Relief Fund. The District Units and Affiliates are requested to maximize the collection/donation and send it to the Prime Minister’s Relief Fund directly under intimation to the Head Quarters.
